Affiliate Terms

1. Program Overview & Independent Status

FAM Pets operates the FAM Pets Affiliate Program to allow approved independent affiliates to earn commission by referring customers to FAM Pets products through approved referral links and discount codes.

Affiliates are independent participants. By joining the program, you confirm that you are NOT:

• an employee, agent, legal representative, distributor, franchisee, joint venturer, or official spokesperson of FAM Pets
• a member of the FAM Pets marketing team, sales team, or staff

Affiliates have no authority to make promises, warranties, refunds, guarantees, commitments, contracts, representations, or admissions on behalf of FAM Pets.

No statement, post, message, email, video, or representation made by an affiliate may modify these Terms, FAM Pets' product labels, refund policy, warranty terms, or official company policies.

FAM Pets is not responsible for your business activities, tax obligations, expenses, or liabilities. You are solely responsible for your own compliance with applicable laws, regulations, and platform policies.

2. Eligibility & Approval

To participate, you must:

• Be a legal resident of Canada or the United States
• Be at least 18 years of age
• Complete the FAM Pets affiliate application truthfully and in full
• Be approved by FAM Pets in writing
• Agree to these Terms

FAM Pets reserves the right to approve or decline any application at its sole discretion without obligation to provide a reason. False or misleading information on your application — including false claims of pet ownership, false audience claims, false identity, or false agreement to these Terms — may result in immediate account termination and forfeiture of pending commissions.

3. Commission Structure

3.1 Base Commission Rate

The standard commission rate for approved affiliates is 12% of qualifying net product revenue, unless otherwise approved in writing by FAM Pets.

3.2 Top Affiliate Rate

FAM Pets may approve selected affiliates for a 15% commission rate based on: 10 or more valid qualifying referred orders or $1,000 or more in referred net sales; zero disclosure or product claims violations; good content or traffic quality; and written approval from FAM Pets. FAM Pets may revoke Top Affiliate status at any time if these conditions are no longer met.

3.3 Subscription Commission

Affiliates earn the standard commission rate on the first qualifying subscription order. Qualifying subscription renewals will earn a 6% recurring commission for up to 6 months from the original qualifying subscription order date, unless the subscription is cancelled, refunded, charged back, or disputed; the renewal is non-qualifying; or the affiliate is no longer in good standing.

FAM Pets may change or discontinue recurring subscription commissions prospectively with reasonable notice. Prospective changes apply to renewals occurring after the notice date only and do not affect commissions already earned on prior renewals.

Recurring subscription commissions apply only to new subscriptions originally created through a valid affiliate referral. They do not apply to existing subscriptions that were active before the affiliate referral, reactivated subscriptions, manually migrated subscriptions, or customers who were already active subscribers at the time of the affiliate click.

3.4 Commission Calculation

Commission is calculated on net product revenue after all discounts. The following are excluded: taxes, duties, shipping, gift card values, refunded or charged-back orders, wholesale and distributor orders, marketplace orders (Amazon, Chewy, Walmart), free samples, replacement orders, and manual orders not tracked by the affiliate platform.

4. Customer Discount Codes

Approved affiliates receive a personal discount code in the format FAM-[NAME], providing customers with 10% off their first qualifying order unless otherwise stated in writing. Codes may not be combined with other discounts without written approval. Commission is calculated after the discount is applied. Codes are for customer referrals only and may not be used for self-purchases. FAM Pets may modify or deactivate codes at any time.

5. Cookie Window & Attribution

The standard referral attribution cookie window is 30 days from the date of click. FAM Pets may approve a 60-day cookie window for selected content creators in writing. Last-click attribution applies where multiple affiliate links are involved. Self-referrals, fake clicks, cookie stuffing, and artificial attribution manipulation are prohibited.

6. Commission Approval, Payout & Return Policy

6.1 Commission Status Stages

Status	Meaning
Pending	Tracked immediately after a qualifying order. No payout at this stage.
Approved	Eligible for payout after the 45-day review period, provided the order has not been cancelled, refunded, charged back, or flagged for fraud.
Paid	Issued during the next monthly payout cycle once all conditions are met.
Reversed	Deducted from future payouts if an order is refunded, charged back, cancelled, or determined non-qualifying within the 90-day return window.

6.2 Minimum Payout Threshold

The minimum payout threshold is $50.00 USD. Approved commissions below this amount roll forward until the threshold is reached.

6.3 Payout Timing

Payouts are processed monthly, subject to manual review by FAM Pets. FAM Pets may delay or withhold payout for any legitimate business reason including suspected fraud, disputed orders, or incomplete affiliate documentation.

6.4 Payment Method

Payouts are made via PayPal unless otherwise approved in writing. FAM Pets is not responsible for PayPal fees, currency conversion charges, or delays caused by PayPal.

6.5 90-Day Return Policy & Commission Reversals

Because FAM Pets offers a 90-day money-back guarantee, FAM Pets reserves the right to reverse or deduct commissions from future payouts if an order is refunded, charged back, cancelled, or determined to be non-qualifying within the 90-day return window.

6.6 Returns Abuse & Unusual Refund Rates

FAM Pets may reverse commissions and suspend an affiliate if referred customers show unusually high refund, chargeback, cancellation, or complaint rates compared with normal program averages, including patterns suggesting low-quality traffic, incentivized purchasing, or fraudulent referral activity.

7. Tax & Payment Documentation

No payout will be made until all required tax and payment documentation has been submitted and accepted by FAM Pets.

U.S. Affiliates: IRS Form W-9 required before payout. FAM Pets will issue Form 1099-NEC where legally required. Affiliates are responsible for all applicable federal, state, and local taxes.

Canadian Affiliates: Legal name, mailing address, province, country, individual or business status, and GST/HST registration status required. FAM Pets may issue a T4A slip (Box 048) where legally required. Affiliates are responsible for reporting commission income to the CRA.

Affiliates are solely responsible for all taxes, levies, or duties arising from their participation. FAM Pets does not provide tax advice.

8. Required FTC & CRTC Disclosure

Affiliates must clearly and conspicuously disclose their material connection to FAM Pets whenever sharing a referral link, discount code, review, post, video, email, story, reel, blog post, or any other promotional content. Disclosure must be prominent and placed near the content it relates to — not buried in a bio or small print.

9. Product Claims Policy

FAM Pets products are pet supplements intended to support general wellness. They are NOT drugs, treatments, cures, or medical devices. Affiliates must only use approved wellness-support language.

9.1 Approved Language

• Supports normal joint function
• Supports digestive health
• Helps protect freshness
• Airless spray packaging helps reduce oxygen exposure
• Individually wrapped soft chews help protect freshness
• My dog loves it / Easy to use daily
• Freshness-focused pet supplements
• Helps make daily supplement routines easier

9.2 Prohibited Claims

Affiliates who make unauthorized claims will be asked to remove them within 24 hours. Failure to comply may result in commission reversal, suspension, or termination.

10. Veterinary & Medical Advice Prohibition

Affiliates may not diagnose pets, recommend stopping medication, recommend dosages beyond label directions, or suggest FAM Pets products are safe for a sick pet without veterinary consultation.

11. Reviews, Testimonials & Marketplace Rules

Affiliates may ask their audience to share honest reviews. Affiliates may not create, solicit, or incentivize fake or misleading reviews on Amazon, Chewy, Walmart, Google, Shopify, or any other platform.

Testimonials involving health outcomes must include this disclaimer:

A disclaimer does not fix a prohibited claim. Affiliates may not make disease, cure, or prevention claims even with a disclaimer attached.

12. Self-Referral & Fraud Prevention

Self-referrals are strictly prohibited. FAM Pets monitors for same-household purchases, fake accounts, commission farming, click fraud, and cookie stuffing.

Repeated offence	Reversal of all related commissions. Possible suspension.
Serious fraud	Immediate termination. Forfeiture of all pending commissions. Possible legal action.

13. Paid Advertising Restrictions

Affiliates may not run paid advertising using FAM Pets brand terms without prior written approval. Prohibited advertising includes Google/Bing Ads bidding on "FAM Pets" or "fam-pets.com"; Meta, TikTok, or YouTube ads that appear to be official FAM Pets advertising; lookalike websites using FAM Pets branding; and retargeting FAM Pets website visitors using the affiliate's own paid media.

14. Coupon, Deal, Cashback & Code Distribution

Coupon sites, cashback sites, browser extension discount programs (including Honey and Rakuten-style tools), loyalty rewards platforms, and deal aggregator sites require written approval from FAM Pets before participating.

Affiliates may not post their discount code on coupon databases, browser extension platforms, discount scraping sites, Reddit coupon threads, deal forums, or any similar platform without written approval. Unauthorized placement may result in commission reversal and account suspension.

15. Platform Rules, CASL & Anti-Spam Compliance

Platform Responsibility: Affiliates are responsible for complying with the terms, advertising policies, disclosure rules, and community guidelines of every platform they use, including Instagram, TikTok, YouTube, Facebook, Google, Amazon, Chewy, Walmart, email platforms, and SMS platforms. FAM Pets is not responsible for any affiliate account suspension or penalty imposed by a third-party platform.

CASL and Anti-Spam: Affiliates must not send commercial electronic messages promoting FAM Pets unless they have legally valid express or implied consent from each recipient, include their own name and contact information clearly in the message, and include a functioning unsubscribe mechanism where required by law. Affiliates may not use spam, purchased email lists, mass unsolicited messages, misleading subject lines, fake urgency, bots, or automated comment spam.

16. Product Complaint & Adverse Event Escalation

Affiliates must notify FAM Pets within 24 hours if any customer reports vomiting, diarrhea, allergic reaction, illness, injury, medication interaction, product defect, rancid smell, leaking bottle, spoiled chew, mold, packaging damage, or any other safety concern.

17. Brand Usage & Trademark Rules

FAM Pets grants affiliates a limited, non-exclusive, revocable licence to use approved FAM Pets logos and copy solely for the purpose of promoting FAM Pets products in accordance with these Terms. Affiliates may not alter FAM Pets brand assets, register domain names or social handles containing "FAM Pets," or present themselves as official FAM Pets employees, team members, or spokespeople.

18. Monitoring & Audit Rights

FAM Pets may monitor, review, request screenshots, request links, audit traffic sources, and require removal or correction of any affiliate content, disclosure, claim, advertisement, landing page, email, post, or message related to FAM Pets at any time. Affiliates must cooperate promptly with any compliance review and provide requested information within 48 hours of a written request. Failure to cooperate may result in commission hold, suspension, or termination.

19. Content Ownership & Usage Rights

Affiliates confirm that all content they create, share, or submit is owned by them or used with appropriate permission. By submitting content to FAM Pets, affiliates grant FAM Pets a non-exclusive, royalty-free licence to use, repost, edit, display, and share the submitted content for marketing purposes unless the affiliate provides written notice to revoke consent.

20. Privacy & Data Security

FAM Pets collects personal data from affiliates including name, address, contact information, tax information, and payout records for program administration and legal compliance only. This data is not shared with third parties except as required by law or for payout processing.

FAM Pets may retain affiliate records, tax documents, payout records, compliance records, and fraud-prevention records for as long as reasonably necessary for legal, tax, accounting, security, dispute, and business purposes. FAM Pets' Privacy Policy covers the collection, use, and disclosure of affiliate personal information and is incorporated into these Terms by reference.

Affiliates must comply with all applicable privacy laws including PIPEDA and applicable U.S. state privacy laws when handling any customer data obtained through affiliate activity.

21. Suspension & Termination

Immediate Termination Triggers: Fraudulent activity, fake orders or clicks, repeated self-referrals, false application information, unauthorized claims not corrected within 24 hours, fake reviews, spam, abusive conduct, misrepresentation of the affiliate relationship, undisclosed conflicts of interest, theft of content, or violation of applicable law.

Soft Warning Triggers: Missing disclosures, borderline claims language, incomplete tax profile, or inactivity will typically result in a warning and opportunity to correct before any suspension.

Non-Termination Triggers: FAM Pets will not terminate an affiliate solely for low earnings, inactivity, honest negative feedback, a pet passing away, using competitor products personally, or disagreeing with a FAM Pets decision.

Effect of Termination: Referral links and discount codes are deactivated. Approved commissions not connected to fraud, policy violations, refunds, or chargebacks will be paid in the next regular payout cycle. All pending commissions remain subject to the 90-day reversal right.

22. Electronic Acceptance

Checking a box, clicking "Apply," clicking "Accept," accessing the affiliate dashboard, using a referral link or discount code, or receiving commissions constitutes electronic acceptance of these Terms in full. Electronic acceptance is legally binding to the same extent as a written signature under applicable law.

23. Survival

The following sections survive termination or expiration of these Terms: tax obligations, commission reversals and fraud investigations, content rights, privacy and data obligations, limitation of liability, indemnification, governing law, dispute resolution, and any outstanding payment obligations.

24. Program Changes

FAM Pets may modify these Terms, commission rates, payout rules, eligibility criteria, discount code terms, geographic restrictions, cookie windows, or tax requirements at any time. FAM Pets will make reasonable efforts to notify affiliates of material changes via email or the affiliate dashboard. Continued participation after a change is posted constitutes acceptance.

25. Limitation of Liability & Indemnification

To the maximum extent permitted by law, FAM Pets' total liability to any affiliate for any claim arising under these Terms is limited to the amount of unpaid approved commissions owed to that affiliate at the time of the claim. FAM Pets is not liable for any indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify, defend, and hold harmless FAM Pets, its owners, officers, employees, and agents from and against any claims, damages, losses, penalties, or expenses arising from your breach of these Terms, unauthorized product claims or health advice, violation of applicable law, fraudulent affiliate activity, or content you created or shared in connection with the program.

26. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia, Canada. Any dispute shall first be addressed through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in British Columbia, except where prohibited by applicable consumer protection law. Nothing in this section prevents FAM Pets from seeking injunctive relief in any court of competent jurisdiction.
